Can either party terminate the lease?
Yes. Both parties can terminate the lease by giving written notice.
How much notice does the landlord need to give?
The landlord must give at least two months’ written notice to terminate the lease.
How much notice does Josephs need to give?
Josephs may terminate the lease by giving at least one month’s written notice.
When does the notice period start?
The notice period runs from the date the notice is served.
What happens when the notice period ends?
Once the notice period expires, the lease comes to an end and the property should be returned in line with the lease terms.
What condition will the property be in at the end of the lease?
The property will be returned in a condition similar to its condition at the start of the lease, allowing for fair wear and tear, as evidenced by the Condition Schedule.
Do you clean the property at the end of the lease?
Yes. At the end of the lease we carry out the standard end-of-lease works set out in the agreement, including cleaning walls where needed and cleaning carpets or replacing basic carpets if damaged, in line with the lease terms.
What happens if the resident has not moved out by the termination date?
In exceptional circumstances, the Council may need a short additional period to secure suitable alternative accommodation for the resident. This can happen, for example, where the household is large or where rehousing within a particular school catchment area is required.
Can the lease be extended after termination notice is given?
Only in exceptional circumstances and only for the purpose of allowing the Council to complete the resident’s relocation.
How long can a short rehousing extension last?
It must be limited to the minimum time reasonably required and cannot exceed four weeks beyond the termination date.
Is rent still paid during a short rehousing extension?
Yes. Rent remains payable in full during any agreed short rehousing extension period.
Does a short rehousing extension create a new lease?
No. A short rehousing extension does not create a new lease and does not renew the existing lease. It is only a short agreed period to allow relocation to be completed.
Why might a short rehousing extension be needed?
This is usually only needed where the Council needs a little more time to find suitable accommodation, most commonly for larger households, more complex cases, or where the resident needs to remain within a particular school catchment area.
